Government Implements Same-Sex Benefits, Furthering End-Run Around Marriage
Federal agencies are implementing a directive from President Obama that extends even more health care benefits to same-sex partners of federal employees – undermining the 1996 Defense of Marriage Act (DOMA). DOMA defines marriage as a legal union between one man and one woman for purposes of any federal rules, regulations or interpretations of the various administrative bureaus and agencies of the United States. The president unilaterally ordered a change to the 1997 Family Medical Leave Act (FMLA) passed by Congress to include a 24-hour “leave without pay” (LWOP) benefit to domestic partners. John Berry, the director of the U.S. Office of Personnel Management – the human resources arm for 2.15 million federal employees – admitted in his Sept. 10 memo to federal workers: “Although FMLA was never amended for these purposes, President Obama continues to support this LWOP policy with a current emphasis to extend coverage to Federal employees with same-sex domestic partners.”
